New York City Webcast March 27th
The Practicing Law Institute’s USPTO Post Grant Trials-2013 (now in its 4th year) will be making 3 more stops across the country in the coming weeks. Next week, the program will make its way to New York City (also available via webcast), several hundred attendees have already registered for the NYC program.
Late faculty additions to the program include former USPTO Director Dave Kappos, and ITC Administrative Law Judge (ALJ) Theodore Essex. This year’s program, which I am once again pleased to chair, coincides with the release of the new treatise entitled Post Grant Proceedings Before the Patent Trial & Appeal Board.

Post Grant Patent CLE
For those seeking CLE in the coming months, there are numerous upcoming options. The Spring Meeting of the Intellectual Property Law Section of the American Bar Association (ABA-IPL) will convene on April 3-5th in Arlington Virginia. On Thursday April 4th, the meeting will kick off with the program “Patentability Trials of the AIA: The First 120 Days.” I will participate in a plenary session with Trial Section Lead, Hon. Michael Tierney of the Patent Trial & Appeal Board. (PTAB)
For those having a particular interest in business method and software patents, I will be speaking at the American University Washington College of Law program entitled: iWars: Legislative, Judicial, and Executive Challenges to the Validity of Computer-Implemented Business Method Patents in the Wake of the Leahy-Smith America Invents Act of 2011 on April 12th.
On April 11th and 12th my partner Todd Baker will be speaking in Dallas Texas on Nuances and strategies for successfully prosecuting and defending IPRs, PGRs, CBMRs before the Board at the AIPLA’s Advanced Practice Under the America Invents Act.

Early 2013 CLE Programs Announced
With 2013 on the horizon, it is time to look forward to a fresh crop of CLE programs directed to the new post grant proceedings of the Patent Trial & Appeal Board (PTAB).
Starting off in January is the 8th Annual Patent Law Institute at the USPTO Alexandria campus. The yearly program, a joint effort of the USPTO, George Mason School of Law, and the University of Texas, is always a huge draw due to the significant participation of USPTO personnel.
Looking forward into the early months of 2013, the Practicing Law Institute’s USPTO Post Grant Trials- 2013is now in it’s 4th year. I will be chairing the program once again, together with Rob Sterne of Sterne Kessler Goldstein and Fox. This year’s program will coincide with the release of the new treatise entitled Post Grant Proceedings Before the Patent Trial & Appeal Board. This years stops include:

Post Grant Patent Practice After the AIA
For those seeking some CLE this week, consider the PLI program tomorrow, entitled How to Effectively Prosecute AIA Post Grant Proceedings 2012. The program is available live in San Francisco, or via webcast, tomorrow, October 3rd. Also, be on the look out for the upcoming treatise from PLI entitled Post Grant Proceedings Before the Patent Trial & Appeal Board.
Upcoming AIA Related CLE
AIPLA will take to the road this October to educate IP professionals around the country on the impact of the AIA-related practice changes effective September 16, 2012. The AIPLA road show will stop in San Jose (Oct. 1st), Chicago (Oct. 3rd), and Arlington, VA (Oct. 5th). USPTO representatives from the Office of Patent Legal Administration (OPLA) and the Patent Trial and Appeals Board (PTAB), together with experienced practitioners, such as my colleague Todd Baker, will walk attendees through the significant practice and rule changes while offering guidance and practice tips.
Scheduled speakers include:
-Chief Judge James D. Smith (Chicago), Vice Chief Judge Jay Moore (San Jose), and Judge Michael Tierney (Arlington) of the PTAB. The judges of the PTAB will discuss the procedures governing inter partes review and governed business method patent proceedings.
-Hiram Bernstein (San Jose), Janet Gongola (Chicago), and Bob Bahr (Arlington) of OPLA. The OPLA representative will discuss the prosecution procedures for implementing the new inventor oath, pre-issuance, and supplemental examination provisions under the AIA.

New PTAB Rules Imminent
The August 16 deadline is fast approaching for the USPTO issuance of the final rules to implement the new patent validity trials of the Patent Trial & Appeal Board (PTAB). The good news is that the USPTO is rumored to be ahead of schedule. In fact, the rule packages are expected to issue next week. As a result, next week’s CLE programs may be the first to touch upon these final rules and their expected impact this September.
In addition to Thursday’s webinar below, the program set for Friday at the ABA annual meeting in Chicago will include Judge Tierney, lead judge of the Trial Section of the new PTAB. Friday’s scheduled round table discussion will discuss the proposed/final rules, assuming the planets align and the government printer stays on track.

Software/e-Commerce Patent Issues
This Thursday, June 14th, my partner Michael Kiklis, a noted software patent specialist, will present ”Are E-Commerce Inventions Patent Eligible? Dealing with Uncertainty after the Remand of WildTangent.” The program will explore the growing morass of case law developing in the patentable subject matter area.

Upcoming CLE
For those looking for some CLE credit this week, I, along with Mr. Andrei Iancu, Irell & Manella; and Mr. John Scott, QUALCOMM, Inc., will be presenting on the IPO Chat Channel (Wednesday, April 18th) Intervening Rights in Patent Litigation.
The program will look at the Marine Polymer case as well as other recent cases in which parallel proceedings before the USPTO have factored into concurrent litigation strategy.
